Which Vaccine Injuries are Eligible for Compensation Under the VICP?

Under the National Vaccine Injury Compensation Program (VICP), vaccine-related injuries and illnesses are broadly separated into two categories: “on-table” injuries and “off-table” injuries. While injuries in both categories are eligible for compensation, there are less steps involved in pursuing a successful “on-table” injury claim.

“On-Table” Injuries and Illnesses Under the National Vaccine Injury Compensation Program

Anaphylaxis

Anaphylaxis is a hypersensitivity reaction that can result from exposure to an allergen. Certain vaccines contain ingredients (such as egg protein) to which many people are allergic, immunization-related hypersensitivity reactions can potentially have severe consequences. Anaphylaxis is listed as an on-table injury for the following vaccines:

  • Diphtheria, tetanus and pertussis (DTaP, DTP, DT, Td and TT)
  • Measles, mumps and rubella (MMR)
  • Polio (IPV)
  • Hepatitis B
  • Varicella (chickenpox)
  • Seasonal influenza (the flu)
  • Meningococcal disease
  • Human papillomavirus (HPV)

Brachial Neuritis

Brachial neuritis (also known as Parsonage-Turner Syndrome) is a disease that can cause severe pain and loss of function as a result of disruptions to the nervous system. Brachial neuritis is an on-table injury for the vaccinations for diphtheria, tetanus and pertussis (DTaP, DTP, DT, Td and TT).

Shoulder Injury Related to Vaccine Administration (SIRVA)

Shoulder Injury Related to Vaccine Administration (SIRVA) are a class of injuries involving damage to the nerves or soft tissue in the shoulder as a result of an error during the immunization process. Some of the most-common errors include inserting the needle too high on the shoulder, too low on the arm, or too deep under the skin. SIRVA is an on-table injury for most CDC-recommended vaccinations.

Vasovagal Syncope

Vasovagal syncope is a condition that causes a sudden drop in heart rate and blood pressure. This can lead to fainting and various other potential injuries and complications. Vasovagal syncope is an on-table injury for these immunizations:

  • Diphtheria, tetanus and pertussis (DTaP, DTP, DT, Td and TT)
  • Measles, mumps and rubella (MMR)
  • Polio (IPV)
  • Hepatitis B
  • Haemophilus influenzae type b (Hib)
  • Varicella (chickenpox)
  • Pneumococcal disease
  • Hepatitis A
  • Seasonal influenza (the flu)
  • Meningococcal disease
  • Human papillomavirus (HPV)

Guillain-Barre Syndrome (GBS)

Guillain-Barre Syndrome (GBS) is a potentially-serious medical condition that causes the immune system to attack the nerve cells. This can have a variety of potential effects, including paralysis. GBS is currently listed as an on-table injury for seasonal influenza (the annual flu shot).

Other “On-Table” Vaccine Injuries

In addition to the medical conditions listed above, other injuries and illnesses listed as “on-table” injuries for certain specific vaccines include:

  • Chronic Arthritis (MMR and MMRV)
  • Encephalopathy and Encephalitis (DTP, DTaP, P, DTP-Hib, MMR and MMRV)
  • Thrombocytopenic Purpura (MMR and MMRV)
  • Vaccine-Strain Measles Viral Disease (MMR and MMRV)
  • Paralytic Polio (OPV)
  • Vaccine-Strain Polio Viral Infection (OPV)
  • Disseminated Varicella Vaccine-Strain Viral Disease and Varicella Vaccine Strain Viral Reactivation (Varicella)
  • Intussusception (Rotavirus)

What if I Haven’t Been Diagnosed with an “On-Table” Vaccine Injury or Illness?

Currently, all other vaccine-related medical conditions are classified as “off-table” injuries. For more information, you can read: How to Obtain Compensation Under VICP When Your Injury Is Not Listed on the Vaccine Injury Table.
